Current Owner Search (O & E)

Also called Owners & Encumbrance Search (O&E), Attorney’s Search, Last Owner Search, Refinance Search.

A Current Owner Search is a search that provides the current vesting deed and all deeds leading back to the most recent out-of-family deed that is at least 24 months old. Also included are copies of any open mortgages and assignments against the current owners, any judgments and liens against the current owners, and also tax assessment and current tax information including any delinquencies.

Two Owner Search

A Two Owner Search is a search that provides the current vesting deed and all deeds leading back to the prior owner’s warranty deed (two full value, warranty deeds will usually be included in the search). Also included are copies of any open mortgages and assignments against any owners found, any judgments and liens against those owners, and tax assessment and current tax information including any delinquencies.

Full Title Search

A Full Title Search involves research on all current title holders and previous owners of the subject property back to a developer or state statute. The chain of title including the current deed is reported, along with all open mortgages, liens and judgements recorded against those same owners, and also tax assessment and current tax information including any delinquencies. Easements, CC&R, agreements etc. affecting the subject property are also included.

Trustee Sale Guarantee Reports

A title report for trustees, disclosing ownership, encumbrances and other pertinent details of the interests in a real property, specifying all parties who have recorded notification requests for any filings against a particular trust deed in foreclosure and lists of all the local publications that qualify to advertise the Notice of Trustee’s Sale. The TSG protects trustees and the beneficiaries from consequences resulting from title record errors associated with the foreclosure proceedings.

Bring Downs/Updates

An extension of a title search to verify that no liens have been filed against the subject property between the time of the original title search and the recording of the Security Instrument and/or Mortgage/Deed of Trust. The taxes should be updated with present tax findings.

Bankruptcy searches

To check if there is any Bankruptcy filed against the borrower by using the PACER site and uploading the search docs in the file.
